PLEASE READ THESE TERMS OF SERVICE CAREFULLY. By scheduling or using the pet waste removal services provided by SIMPLY SCOOP LLC, you agree to be bound by these Terms and Conditions.
Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of these Terms and Conditions:
Affiliate means an entity that controls, is controlled by or is under common control with a party.
Country refers to: TX, US
Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Simply Scoop LLC, 827 S Ridgeway Dr Cleburne, TX 76033
Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
Service refers to the Website. Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
Website refers to Opt in Page, accessible from https://simplyscoop.com/
You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
1. Mobile Messaging Terms (SMS)
By providing your phone number and opting in via our website forms, you agree to receive recurring automated marketing and service-related text messages (e.g., service reminders, quotes, and scheduling updates) from Simply Scoop LLC.
Consent: Consent to receive automated marketing text messages is not a condition of any purchase.
Opt-Out: You can cancel the SMS service at any time. Just text “STOP” to our number. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed.
Help: If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at info@simplyscoop.com.
Cost: Message and data rates may apply. Message frequency varies.
Liability: Carriers are not liable for delayed or undelivered messages.
2. Acknowledgment
These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.
You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.
3. Privacy Policy & Data Sharing
Your access to and use of the Service is also conditioned on Your acceptance of our Privacy Policy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
4. Links to Other Websites
Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.
The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.
5. Termination
We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.
Upon termination, Your right to use the Service will cease immediately.
6. Scope of Services
SIMPLY SCOOP LLC will provide pet waste removal services at the address specified by the Customer. Services include the removal of pet waste from designated yard. We will double bag the waste and dispose of it in your provided trash receptacle. We will disinfect the trash receptacle. If we do not have access to your trash receptacle at the time of service, we will leave it near the gate or designated yard entrance point. If you sign up for deodorizer or disinfectant treatment, we will connect our water hose to your spigot and apply treatment to all grassy or hard surface areas within 25’ of the water spigot, unless otherwise agreed-upon.
7. Customer Responsibilities for Dog Poop Cleanup
To ensure the safety of our technicians and the effectiveness of our Services, you agree to the following:
Access to Property: Your property must be accessible to our technicians on the scheduled service day. This includes, but is not limited to, unlocked gates and clear pathways to the service area. If we are unable to access the service area due to a locked gate or other obstruction, you will be notified, and the service will be skipped. We will return on your next scheduled day. No monetary credit will be due for the skipped visit.
Aggressive Animals: For the safety of our technicians, all aggressive or nuisance pets must be secured indoors or in a separate, contained area away from the service area during our visit. We reserve the right to refuse service if a pet is loose in the yard and perceived to be a threat or impedes our ability to service your property safely and effectively. In such cases, the full service fee for that visit will still apply.
Yard Maintenance: The service area must be free of tall grass, excessive leaves, debris, or any other materials that may obstruct our ability to locate and remove pet waste. We will still attempt to service the yard if these obstructions are present, but we cannot guarantee the quality of the visit.
Health and Safety: You are responsible for ensuring your property is free of any known hazards, such as venomous insects, snakes, or unstable ground. Please inform us of any potential hazards in advance.
8. Billing and Payment for Pet Waste Removal
Service Rates: Our rates are based on the number of pets, the size of the service area, frequency of service, and amount of time since last cleaning.
Payment Due Date: For recurring services, a prorated charge for the remainder of the current month is due on the day of your first service. Ongoing service is then automatically billed at 9:00 p.m. on the last day of each month, for the following month’s service.
Late Fees: A late fee of $10.00 may be applied to any invoice not paid within 7 days of the due date, and an additional $1 per day after the 7th day after the due date, until payment is made in full.
Payment Methods: We accept payment via credit card or bank transfer. We require credit card or bank information to remain on file in your client portal account for automatic draft on the last day of each month.
Failed Payments: If a payment fails due to invalid/incorrect information or rejection by your credit card company/financial institution, the payment will automatically be re-run one time. If the second payment is not successful, you will receive a text and/or email informing you of the failed payment. You will be taken off the service route until payment is successfully made, and at that time, you will be added back into the rotation on your next regularly scheduled service day. We may charge an NSF fee if your payment is returned by your credit or banking institution.
Deposits: We collect and apply all deposits according to the specific terms outlined in your quote.
9. Service Schedule and Cancellation
- Service Schedule: We require an in-person meeting for your first visit, and this visit will be at a preset time scheduled between us and you. Your recurring service after that initial visit, will be scheduled for a specific day of the week, at no guaranteed time. While we strive to maintain a consistent schedule, we reserve the right to alter service days due to unforeseen circumstances. We will notify you of any permanent changes to your service day.
- Inclement Weather: In the event of severe or inclement weather (e.g., heavy rain, thunderstorms, extreme heat, icy conditions), we reserve the right to reschedule your service for the safety of our technicians. We will notify you as soon as possible of any weather-related delays. We will delay service if possible, to allow weather conditions to improve. If we are unable to service your yard on your service day, we will skip the service day and resume on your next regularly scheduled service day. No credit will be due, as we will be cleaning twice as much waste on the next visit.
- Holidays: We observe the following holidays: New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Eve, Christmas Day. If your scheduled service falls on a holiday, we will notify you of the alternate service day or discuss other options with you.
- Cancellation Policy: You may cancel or suspend your service at any time by providing notice, at least 48 hours prior to your scheduled billing date. If you cancel with less than the required notice, you may be charged for the scheduled service. Cancellation can be done via the client portal at any time, or by calling us directly. Suspension can be requested by contacting us by phone, text, or email. Suspensions are only accepted if the pet will be away from the home for an extended period of time, i.e. vacation, boarding, etc. “Extended period of time” shall be defined as any amount of time in excess of 14 consecutive days in which no pets will be on the property.
- Other Skipped Service Visits: If we need to skip a service due to our own scheduling or operational reasons (not related to the circumstances listed above), we will provide you with an alternative service day or discuss credit options with you. If you request a service skipped that is not already approved for a service suspension, or if a payment delay/failure causes us to skip your service, no credit will be due. We will simply resume service on your next scheduled day.
- Multiple Missed Service Visits: If service is paused or missed for more than 21 consecutive days due to circumstances beyond our control or as a result of inclement weather, a $60 initial cleaning fee will be required to address the accumulated pet waste before regular service resumes.
10. Satisfaction Guarantee
We guarantee a spotless yard, within the scope of the agreed-upon service. If you are not completely satisfied with our pet or dog poop cleanup service, please notify us within 24 hours, and we’ll return and re-clean the area at no additional charge.
11. Limitation of Liability and Disclaimer
Pet Safety: SIMPLY SCOOP LLC and its employees are not responsible for the safety or well-being of your pets. While we will make every effort to ensure gates are securely closed upon entering and leaving your property, we are not liable for any pets that may escape your property. It is your sole responsibility to ensure your pets are secure.
Property Damage: We are not liable for any damage to your property, including but not limited to, landscaping, sprinkler systems, water spigots, locks, or gates, unless such damage is a direct result of our gross negligence or willful misconduct.
Health Disclaimer: While our services aim to improve the sanitation of your yard, we do not guarantee the complete elimination of all pet-related bacteria or parasites. We are not liable for any health issues that may affect your pets or family members.
12. Legal Compliance (Texas Pet Services Law)
As a pet service provider in Texas, we adhere to all applicable state and local regulations. By using our Services, you acknowledge that you are responsible for complying with any local ordinances regarding pet ownership, vaccination, and registration in Texas, your county, and your city.
13. Changes and Governing Law
We reserve the right to modify these Terms at any time. All changes to these Terms will be made on this page. We will make efforts to notify active customers of major changes. Your continued use of our Services after these changes constitutes your acceptance of the new Terms. These Terms shall be governed by and construed in accordance with the laws of the State of Texas.
